As part of our ongoing commitment to keeping clients informed, Arium AE is sharing several recent permitting and code updates that may affect commercial projects in the region.
Fairfax County, VA
The Board of Supervisors has approved a fee increase for most applications to Land Development Services and the Department of Planning and Development, which takes effect on July 1, 2026. The changes reflect the impact of inflation, rising personnel costs, and the overall increase in the cost of providing county services. All fee changes will apply only to applications submitted on or after July 1st. Applications filed before July 1st will be subject to the fees that were in effect at the time of filing.
Technology surcharge fees and the code academy surcharges will remain flat with no increase for FY27. A link to the adopted fees is here: LINK.
Montgomery County, MD
The Montgomery County Department of Transportation (MCDOT) has released a series of updated design guidelines for infrastructure projects. These new guidelines will apply not only to new construction but also to infrastructure that is being reconstructed or replaced. The guidelines include regulations for sidewalk and path widths, driveway ramps, curbs, and bike paths.
“We are fully committed to meeting accessibility standards and ensuring our partners have a clear, predictable path to compliance,” said Montgomery County Executive Marc Elrich.

Effective July 1, at the start of the 2027 fiscal year, the Department of Permitting Services will implement a 15 percent increase to permitting fees. This will be the first adjustment to these fees in seven years. If you have questions about the updated fees, call 240-777-0311.
West Virginia
As of June 1, 2026, the West Virginia Board of Architects is offering architects greater flexibility regarding how they seal documents, including more security for those who choose the digital seal and signature option. If digital options are chosen, certain conditions need to be met. Dates are now required with the seal and signature application. More information can be found here: LINK.
BEPS
Building Energy Performance Standards (BEPS) benchmarking reports and exemption requests are due by June 30th. The BEPS portal is now ready to accept payment of this year’s annual reporting fee of $100.00 per building.
The 2026 building statuses have been updated in the BEPS portal. A “No submission” status is displayed when neither a benchmarking report nor an exemption request has been received for that building’s 2026 requirements.
